- Wrongful DeathIn Florida, wrongful death cases are strictly controlled by its state statute which sets forth the definition of “survivors” which explains who may recover damages and what damages may be recovered. (See Florida Statute 768.16 to 768.26, known as “Florida’s Wrongful Death Act.”) Survivors are the spouse, children, parents, and when wholly dependent on the decedent for support or services, any blood relatives and adoptive brothers and sisters. In an wrongful death case, a relative is appointed the personal representative of the estate and the survivors.
- Traffic ViolationsA ten-year-old autistic boy was outside of his house with his babysitter at an ice cream truck parked across the street from his house. All of the sudden he darted out into the street and was struck by a car. He suffered a severe laceration to his head, internal bleeding, and bruising on his arm, legs, and abdomen. He was transported by ambulance to a children’s hospital where he was admitted for three nights. The driver was a 17-year-old kid from the neighborhood. We heard that this driver had been speeding and we obtained 911 tapes of two neighbors that had called the police reporting this boy who was speeding.
- RobberyTallahassee, bought a paring knife, and attempted to hijack a car and driver from a shopping mall parking lot on June 24, 1990. Faye Vann, who was seated in the car, resisted, and Dillbeck stabbed her several times, killing her. Dillbeck attempted to flee in the car, crashed, and was arrested shortly thereafter and charged with first-degree murder, armed robbery, and armed burglary. He was convicted on all counts and sentenced to consecutive life terms on the robbery and burglary charges, and, consistent with the jury’s eight to four recommendation, death on the murder charge.

- Property DamageThis Audi A4 should have been declared a total loss. The cost to repair was $14,267.04 which was paid for by our client’s insurance company. The at-fault insurance company had $10,000 in property damage liability insurance, and our client’s insurer wanted its $10,000 policy limit. We were successful in reaching an agreement with our client’s insurance company to permit our client to receive the full $10,000 from the at-fault insurer for his diminished value and loss of use claims even though our client’s insurer would receive nothing.
