- Workers CompensationIf you have been injured on the job, you are likely covered by workers’ compensation laws that allow for recovery of your medical expenses, a percentage of your wages, plus other compensatory damages. State and federal laws require that employers carry workers' compensation insurance in order to provide for employees injured or killed on the job. Workers’ Compensation laws are statutes that establish liability of employers for injuries to workers while on the job or illnesses due to their employment, and require insurance to protect the workers. Workers’ compensation is not based on negligence of the employer, but is absolute liability.
- Property DamageThe laws regarding automobile accidents are complex and can be very confusing. Many states have mandatory Personal Injury Protection Benefits (sometimes called No-Fault benefits) and/or Medical Expense payment benefits on all automobile insurance policies issued in that state. In some states, Personal Injury Protection Benefits can be coordinated with other medical or disability benefits to insure maximum compensation to the injured person. It is very difficult for an individual to understand the complex nature of these auto insurance benefits. Some states, not all, have provisions in the automobile insurance policy that allow for the reimbursement of lost wages if you are unable to work as a result of an automobile accident. Property damage to an automobile could be negotiated with your own automobile insurance carrier or with the insurance carrier for the negligent driver. Many states have adopted tort reform legislation that limits the ability of people injured in an automobile accident to recover damages. Lastly, there are significant differences between the benefits that are offered on a car, motorcycle or commercial vehicle. Whenever you have been in an accident, as a driver, passenger or pedestrian, and have any questions, feel free to contact us.

- Medical MalpracticeBirth injury is damage sustained during the time the unborn child is developing in the womb or during the birthing process. Medical Malpractice is sometimes a cause of traumatic injuries during birth. Common delivery errors during birth include improper use of forceps or vacuum, failure to monitor fetal strips and failure to perform caesarean section. Significant injuries can occur when the doctor or nurse fails to read the fetal monitoring strips. If the strips indicate fetal distress then the doctor must act immediately or the unborn child could be deprived of oxygen and the baby can sustain brain damage that could have been avoided.

- Slip and Fall InjuryThe standard to establish liability in Slip and Fall cases vary in the many states in which we practice. However, while the law of each state may vary, there are certain issues which are consistent throughout slip and fall cases in every state. Regardless of where you reside, it is my professional opinion that you involve an attorney early in a slip and fall case so that the attorney can do a proper investigation of the accident scene. Never assume the accident scene will remain as it was on the date of your injury. Many of the conditions that caused a slip and fall injury can be corrected or cleaned or lost in a short amount of time. If you have been injured in a slip and fall incident, it is critical that you obtain and document information quickly after the accident.
