Criminal Law

• Criminal Defense
  The Appellate Practice Group prosecutes and defends civil and criminal appeals at all levels of federal and state practice.
• Wrongful Death
  , Successfully defended oil company in product liability wrongful death action alleging defective design of tanker truck. Granted summary judgment dismissing litigation against the defendant.
• Sex Crimes
  Currently representing plaintiff in case involving claims of rape, false arrest and malicious prosecution against a city municipality and employees
• Fraud
  He represents hospitals, ASCs and other outpatient facilities, physician groups, laboratories, pharmacists, technology companies, and medical suppliers. He serves as regular corporate compliance counsel to health industry clients, including large urgent care practices and complex multispecialty practices operating in New York and Connecticut. Mr. Braumuller has extensive experience representing health industry clients on compliance with the Stark Law, anti-kickback statutes and other health care fraud and abuse and health care regulatory laws.

Business and Corporate Law

• Corporate Law
  Mr. Markert is General Counsel to the firm and a member of the Litigation Practice Group. His experience covers a broad range of commercial matters, including complex breach of contract, fraud, business tort, and securities disputes; corporate governance and control disputes; arbitrations and mediations, including matters administered by the Financial Industry Regulatory Authority (FINRA) and the American Arbitration Association; director and officer liability cases; attorney and accountant malpractice claims; significant insurance coverage disputes; commercial warranty claims; and numerous other litigated and arbitrated matters. Mr. Markert also counsels clients on risk management and litigation avoidance, and is experienced in conducting internal investigations.
• Mergers and Acquisitions
  He has handled mergers and acquisitions of hospitals and other health care facilities, including Georgetown University in the sale of its Medical Center and St. Vincent’s Medical Center on its acquisition of the Catholic Medical Center, with the value of each transaction in excess of $200 million.
• Business Disputes
  Mr. Parisi has represented several major companies in complex commercial, toxic tort, products liability and environmental contamination actions filed throughout the United States.  He represented a multi-state petroleum distributor in a mass tort, product liability multi-district litigation pending in the Southern District of New York.  Mr. Parisi has also represented area municipalities, corporations and individuals in environmental and zoning disputes, including CERCLA “Superfund†cost recovery actions, RCRA, Clean Water Act and Safe Drinking Water Act lawsuits, and cases involving other local, state and federal environmental laws and regulations.  Mr. Parisi has also represented national retail stores, area businesses, municipalities and individuals in commercial business disputes in state and federal court.  In addition, Mr. Parisi has represented several area cemeteries and individuals with respect to burial and other cemetery issues.  Mr. Parisi has extensive trial experience in both state and federal courts and is experienced in mediation and alternate dispute resolution in environmental, construction and general civil matters.

  Sabrina Blefgen is a member of Bleakley Platt & Schmidt, LLP’s Real Estate and Commercial Finance Practice Groups. She has nearly a decade of experience in the practice of real estate and has represented sellers and purchasers in connection with both residential and commercial transactions. She also focuses on commercial office and retail leasing.  In addition, Sabrina has experience representing lenders and borrowers in commercial financing transactions.

  Before joining the Westchester County Attorney’s Office, Mr. Rodriguez clerked for Chief U.S. District Court Judge Dora L. Irizarry and U.S. Magistrate Judge Ramon E. Reyes, Jr., both of the Eastern District of New York. He also previously practiced intellectual property litigation at Morgan & Finnegan, LLP.

  Member of United States Department of Justice trial team in the prosecution of International Business Machine Corporation (IBM), for antitrust violations in the U.S. District Court for the Southern District of New York.

Employment Law

• Wrongful Termination
  Adler v. Gruma Corporation d/b/a Mission Foods, et al, 3:2022cv06598 (U.S.D.C. Dist. of New Jersey). Representing plaintiffs in wrongful termination of route involving franchise law violations, wage and hour claims and unlawful termination under both State and Federal law.
• Employment Discrimination
  Mr. Harrington is Chairman of the Firm’s Executive Committee and head of the Litigation Practice Group. He is an experienced trial attorney who has represented Fortune 500 companies in criminal, commercial, environmental, civil rights, real estate, gaming, and employment discrimination matters. His clients have included major oil and pharmaceutical companies, hospitals, racetracks/casinos, financial institutions, and significant regional companies in all aspects of complex environmental, toxic tort, and commercial litigation. Mr. Harrington also represents both municipalities and developers in all phases of land use development and related litigation.
• Employment Contract
  Successfully defended the president of a closely-held telecommunications equipment manufacturer against a shareholder’s claims that he had breached his fiduciary duty and an employment contract by allegedly conspiring with the company’s accountants to inflate their fees and by approving excessive expenses. The case was resolved at an early stage of the litigation, with the client paying nothing in settlement.
• Employment Litigation
  Currently, Mr. Loveless serves as Counsel to the Town Attorney for the Town of Pound Ridge and previously served as Counsel to the County of Westchester Industrial Development Agency. He has tried numerous cases to verdict and argued appeals in State and Federal Courts, including the Second Circuit and New York’s Court of Appeals including a $20,000,000 subrogation claim that was ultimately decided by the Second Circuit Court of Appeals. Additionally, through his work with the Uniformed Firefighters Association, he was involved in negotiating labor agreements and handling disciplinary matters. His extensive work in the field of education law involved employment issues, discipline and question of tenures, including a matter also decided by the Second Circuit Court of Appeals.
• Severance Agreement
  Mr. DeGiuseppe advises clients on a wide variety of labor and employment law issues involving employment terminations and discipline; unlawful discrimination, harassment and retaliation; wage and hour claims; employment agreements and job offer letters; non-competition and confidentiality agreements; separation and severance agreements;  unfair labor practice charges; union representation cases; and collective bargaining negotiations. He has acted as lead counsel for significant employment discrimination law cases, wage and hour actions, and non-competition cases, and in NLRB and PERB proceedings, mediations and arbitration hearings.

  Mr. Quinn is thoroughly familiar with local and state zoning practices, procedures and environmental law. He regularly appears before planning boards, zoning boards, village and town boards and architectural review boards for his clients. He currently represents many of the major companies and developers in Rockland County on land use and zoning matters, including utility companies, major financial institutions, title companies, developers and large property owners.

  We regularly represent owners, contractors and design professionals in claims for property damage arising during construction and after completion.

• Personal Injury
  Mr. Orlowski is a member of the Litigation practice group. His practice involves the defense of trucking and transportation claims, premises and automobile liability matters as well as personal injury matters arising from construction-related accidents involving the application of the New York State Labor Law and violations of the New York State Industrial Code. He has litigation and trial experience in the New York City and Westchester County State and Federal Courts.
• Medical Malpractice
  Mr. Rand is a member of Bleakley, Platt & Schmidt’s Litigation and Insurance Defense practice groups.  Prior to joining us, Mr. Rand represented a variety of corporate and individual clients in complex commercial litigation matters, real estate litigation, product liability, medical malpractice, and catastrophic personal injury.

• Estate Planning
  Our friend, our colleague, and our Chairman, William F. Harrington, passed away at the age of 78 in January, 2010. “BJ” Harrington joined the Firm in 1959, where he practiced law for 51 years and served as our Chairman and Managing Partner for 35 years. He was an accomplished attorney in trust and estate litigation and oversaw the growth of Bleakley Platt into one of the premier law firms in the region. He also served as Legislative Counsel to Lt. Governor Malcolm Wilson between 1964 and 1973, as Town Attorney for the Town of Pound Ridge from 1980 to 1985, and Town Justice for the Town of Pound Ridge between 1985 and 1991. BJ received a degree in accounting from Manhattan College in 1953 and his law degree from Fordham University School of Law in 1959.

  Ms. Barcia handles a broad range of matters with a particular emphasis on estate administration, drafting of wills and trusts, special needs planning, and guardianship proceedings under Article 81 of the Mental Hygiene Law and Article 17A of the Surrogate’s Court Procedure Act.
