- Workers Compensation InsuranceIt might also be important to note that liability may be imposed differently depending upon the triggers causing the loss. For example, general liability is the standard of liability for every day operations and interactions. In this view, Courts hold that each person owes a duty to act in a reasonable way so common standards of care and behavior are the guideposts in establishing negligence. Products liability, on the other hand, pushes up the duty imposed on a business. Courts hold product liability as strict liability. Strict liability is the obligation to protect someone from injury or property from damage when a product is held to cause the injury or damage. There is little defense against strict liability but products liability is considered to be an area where a business is held to a higher standard of care and duty. There is also absolute liability. In cases where activities and operations are so inherently dangerous, damage or injury is likely. In this view, let’s consider the companies conducting certain types of operations – say blasting rock to create a roadway – and they cause damage to nearby homes that lose windows or cracks develop in the foundation of the home. The company blasting is held responsible under notions of absolute responsibility. There are also professional liability, employment practices, workers compensation, vicarious liability, and similar extension of responsibility that should be thoroughly evaluated for your operations.

Risk management can only carry your business so far and then you need the protection of a commercial umbrella.
- Professional Liability InsuranceThe big difference found in Professional liability insurance is that you don’t even have to have been wrong for a claim to have been triggered. A Client may claim that you have simply made any error in judgment or omitted advice or consideration of key facts when rendering your advice or counsel or service. These are claims that are generally not covered by business general liability coverage. Usually the trigger for a claim is when an injury or property damage was caused by a product or other service. When a product is your advice it is far more difficult to defend.

Let’s face it: No matter how careful you are we all make mistakes. Some of those mistakes cause injury and hardship to others and in our litigious world that can be expensive to defend and impossible to afford without umbrella insurance. Any reasonable method we can use to diminish or eliminate our vulnerabilities to casualty loss is money well spent and this especially true for who could be devastated financially in a court of law.
- Flood InsuranceOne of the biggest reasons flood insurance claims remain persistently high is that for years building codes did not discourage construction of homes or commercial property in flood prone areas. This includes coastal areas where billions of dollars of property damage are done solely because people have built closer and closer to the water. The same goes for the attraction of inland rivers, lakes, and streams where the views are fantastic but the risk to property is substantial. The source of flood water isn’t always obvious. By definition a flood is surface water that aggregates on normally dry land because it is unable to easily move away from structures as it might otherwise. This occurs when rain falls at high rates, when water is driven by wind and piled up on land where houses and buildings are built (often referred to as the “storm surge”), and by unusually rapid winter snow melt that causes ice and water to back up onto land that is normally dry.
