- Restraining OrderWith your divorce petition, or in your response to your spouse's petition, you can request a temporary restraining order to prevent the inappropriate spending or disposal of any property. Our attorneys will assist you in recognizing the need for such an order and presenting the motion to the court.
- Estate PlanningIf an order is issued, you and your spouse may not transfer, use, conceal, or otherwise spend any marital or non-marital assets without permission from the court or the other party. Normal, everyday expenses are not included, as the law recognizes the need for each spouse to continue daily living. You will still be permitted to pay your mortgage, buy groceries, and make insurance premium payments, but putting a down payment on a new home or car requires notification. Similarly, the order may prevent you from changing account beneficiaries or estate planning documents until the divorce judgment is finalized.
