  Defended an employer-garnishee in a garnishment action brought by an employee’s creditors and successfully argued to the Oklahoma Court of Civil Appeals that the Consumer Credit Protection Act precludes certain garnishments when some child support income assignments are already in place, which was previously an unsettled area of law in Oklahoma.

  Jim's practice further extends to representation of clients in guardianship proceedings, adoptions and step-parent adoptions. • Criminal Defense

  In Oklahoma, State Courts are authorized to use videoconferencing in place of court appearances. [ii] The Rule “is intended to provide a judge presiding over any matter in District Court with broad discretion regarding the use of videoconferencing.†[iii] Meanwhile, in response to the COVID-19 pandemic, Federal Courts in Oklahoma have provided instruction for implementing similar videoconferencing for several types of proceedings. In the Northern District of Oklahoma, proceedings may be conducted by video conferencing for detention hearings, initial appearances, preliminary hearings, waivers of indictment, arraignments, probation and supervised release revocation proceedings, pretrial release revocation proceedings, misdemeanor pleas and sentencings, among other proceedings. [iv] The Western District of Oklahoma has issued a nearly identical Order. [v]

Employment Law

• Workers Compensation
  Although we often represent injured workers, our firm also handles workers' compensation cases for employers and insurers. We regularly counsel employers regarding pay and benefits, discipline, and other issues that arise when an employee is injured on the job.   Pursued enforcement of a pre-bankruptcy employment contract on behalf of a former executive of a corporate Chapter 11 debtor and pursued payment of the executive’s claim from the reorganized debtor.
• Employment Litigation
  James M. Love is a shareholder at Titus Hillis with over thirty-seven years of civil litigation experience. Early in his career, Jim practiced in San Francisco, California, with a large international law firm defending insurance bad faith and toxic tort claims. After returning to Tulsa in 1992, his practice focused on products liability, toxic torts, and professional malpractice claims.
