  Kurt is a board-certified trial lawyer by the Florida Bar Board of Legal Specialization and Education; and the National Board of Trial Advocacy in Civil Trial Law. Kurt has over 30 years of experience and has tried approximately 80 civil jury trials, including at least 10 wrongful death cases. He has represented motor carriers for most of his career, but over the past 10 years, his work in this area has increased to approximately 50% of his practice. Kurt is currently the Chair of Wicker Smith’s Transportation Practice group, which oversees the transportation practice in a 250+ attorney, 16 office law firm. He has also been designated as a major case unit attorney assigned to handle catastrophic and brain injury claims for Zurich North America. An ardent litigator, Kurt has earned a number of distinctions including an AV® Preeminent™ rating by Martindale-Hubbell and is an active member of various professional organizations.

  Jaime Baca and Rafael De Armas of our Miami office represented the defendant in a premises liability case. The plaintiff requested $1.25 million in damages, however, our attorneys obtained a favorable defense verdict.
• Construction Litigation
  Wicker Smith expertly represents parties in all capacities in construction disputes, including general contractors, subcontractors, architectural and engineering design professionals, and owners and developers.  We have extensive experience in representing and defending parties in construction defect disputes involving all areas of construction, from project design and engineering to construction to acceptance and approval by the governmental agency.  Wicker Smith is adept at handling construction disputes from pre-suit through trial. We also advise clients on issues pertaining to regulatory compliance, including OSHA compliance, insurance coverage, potential liability, contract language and drafting, and pre-suit investigation and defense, among many others.  Our attorneys routinely handle cases involving large commercial developments such as office parks and shopping malls, office buildings, commercial and industrial structures, high-rises, condominiums, residential subdivision developments, and residential homes ranging in value from $300,000 to more than $100 million.

  Our attorneys, Holly Howanitz, Kevin Mercer, and Adam Remillard, were involved in an automobile liability case of adverse liability with significant property damage and airbag deployment. While the plaintiff was looking for $365,000, the jury returned a verdict for only $7,771.86.

  Kevin Crews, Ashley Withers, and Michael Shue of our Naples office were involved in a complex medical malpractice case. Although the plaintiff demanded $4.5 million, our attorneys received a favorable defense verdict.

Trusts and Estates

• Estate Planning
  Successfully defended the estate plan from charges of undue influence and breach of fiduciary duty by the estate planning lawyer. The remainder beneficiary charity sought to vacate the last amendment to the trust to get the whole trust because the testator’s last revision after all the testator’s friends and family had died provided for a gift to the charity and the longtime lawyer.
