- Wrongful DeathWrongful Death is a generic term that applies to situation where a person dies as a result of someone else’s negligence. Where there has been a violation of a legal duty that results in the death of a person, that is considered a wrongful death case. These cases are normally brought by the person appointed as the personal representative of the decedent’s estate. However, the damages due to the death are owed to the persons who would normally be the heirs of the deceased person. At the end of a case, the trial judge many times is required to hold a hearing to determine the relatives who will be awarded damages and the amounts that should be awarded to each individual relative.
- Business DisputesWhile attending law school, I left a law review appointment for the experience of working at a top notch law firm specializing in personal injury and workers’ compensation. I was a law clerk at a personal injury and workers’ compensation law firm during law school. I was sworn into the State Bar of Michigan and the United States Federal Court on May 10, 1977 and have been practicing since that date. I was a trial attorney for law firms specializing in personal injury and workers’ compensation, opening my own office in 1981. I have obtained the highest rating possible in both competency and ethics from the Martindale-Hubbell attorney rating association which is a rating awarded by other attorneys. I have extensive trial experience having successfully tried construction accident cases, medical and legal malpractice cases, automobile collision cases, workers’ compensation cases, police misconduct claims (long before the advent of video) and business disputes. I was an adjunct member of the Workers’ Compensation Appellate Commission, acting as an appellate judge on Workers’ Compensation cases.

- Wrongful TerminationThese are damages awarded in a wrongful discharge case where the employee is supposed to return to work but the employer does not return the employee to his or her old job or does so after the judgment is entered. This is the amount of damages between the time of the judgment and the return of the employee to the proper position.
- Employment DiscriminationSuccessful claims are normally based upon some action on the part of the employer that violates a civil rights statute, the Family Medical Leave Act, a failure to make a reasonable accommodation under the Americans with Disabilities Act, an adverse employment action (like a discharge) for violating a Whistleblower statute or illegal age discrimination.

- Social Security DisabilityMost people applying for Social Security are requesting Social Security Disability or Supplemental Security Income. In either event, the test for receiving Social Security is whether the injured person is unable to engage in any substantial gainful work activity because of a severe and medically provable physical or mental impairment or impairments which has either lasted or can be expected to last for twelve continuous months or to result in death. Most denials are based upon a medical issue concerning whether the disabled person meets the test of disability.
- Dog BitesDog bites are generally considered “strict liability” cases. This means that in general, if a dog bites someone, the dog owner is liable for the damages. However, if the dog is provoked, then strict liability does not apply. There have been cases where provocation has been something obvious, such as taunting a dog with a stick. Other cases have not been so obvious, such as a child who comes up to a dog while the dog is eating.
