- DUI/DWIThe reason we care so much about car accidents is that we hope to make a difference in our cases. For every car accident case we pursue, bad drivers and their insurance companies are forced to be held accountable, which promotes safer driving in the future. This idea is particularly important in car accidents involving drunk driving, texting and driving (or other cell phone use while driving), and/or drug use and driving. We take these cases very seriously, because we don’t want it to happen to the next person.
- Wrongful Death
- Sex CrimesInjuries to person or property can result from many unexpected situations. If you have been injured and it was caused by another’s fault or carelessness, you may have a personal injury claim. Some common examples of personal injury claims include: dog bite, motorcycle accident, construction accidents, bad faith, fraud, consumer protection, sexual assault or rape, wrongful termination, employment law, discrimination, drunk driving accidents, bus accidents, trucking accident, and any other injury claim in Montana. Contact us for questions about your injury claim.
- Assault
- Workers Compensation
- Wrongful TerminationMost claims take the form of wrongful discharge, which is governed largely by the Montana Wrongful Discharge from Employment Act. Wrongful discharge claims are tough, and the Montana legislature has not been kind to Montana workers.
- Employment LitigationOne common type of claim stems from an employment situation gone bad, often called wrongful discharge or wrongful termination. Perhaps you are wrongly fired from your job, or worse, discriminated against based on race, sex, age, gender, etc. You certainly suffered an injury in the form of lost wages, emotional damage, humiliation, and other damages. We handle many employment claims.
- Premises Liability
- Property DamageClass actions can arise when a large number of people suffer a similar injury, property damage, or consumer protection harm due to a similar or same act of wrongdoing. Class actions often involve hundreds or thousands of individual claims that are individually of a small value but collectively are valuable.
- Personal InjuryInsurance law questions arise in a variety of areas including automobile insurance, homeowners insurance, general liability insurance, life insurance, etc. Insurance is meant to provide coverage contingent upon the happening of a risk causing harm. We most often see insurance issues arise as an offshoot of a claim for personal injury. Oftentimes claimants are told by an insurance agent or adjuster that the policy does not cover a loss. However, courts are the ultimate decision maker.
- Medical MalpracticeOne significant component of the special legislation is the Montana Medical Legal Panel (MMLP). The MMLP is an administrative and non-binding process aimed specifically at “prevent(ing), where possible, the filing in court of actions against health care providers and their employees...” MMLP proponents claim of course that it is meant to only discourage frivolous lawsuits, but it is an intimidating, costly and onerous process that discourages legitimate claims from unrepresented medical malpractice victims. It works, and the practical effect of the MMLP process has been to shield negligent and careless doctors, creating a health care system that often avoids accountability.
- Auto Accidents
- Disability DiscriminationWe see many employment claims involving disability discrimination as a result of our practice representing injured people and workers’ compensation claimants. Employers often play games with disabled individuals and unfairly treat disabled people, resulting in illegal discrimination. We also handle other forms of claims stemming from illegal discrimination with the Human Rights Bureau.
