Attorney Nathan Zeltzer has practiced for more than 25+ years and has represented creditors and debtors in numerous bankruptcies. 70% of the cases filed are Chapter 7 cases. In a Chapter 7 case, most debts are dischargeable. You are allowed to keep all property that is exempt under the Nevada Bankruptcy Exemption Code. In most cases, all of your property will be exempt. Typical legal fees are $900 for a chapter 7 plus $335 for the filing fee. Chapter 13 Bankruptcy: certain debts can be discharged in a chapter 13 that cannot be discharged in a chapter 7. Filing & bankruptcy allows you to stop a foreclosure and in a Ch.13 you can include delinquent mortgage payments, and pay these back payments for an extended period of time. You have the right to stop a foreclosure proceeding and cure mortgage arrearages over a reasonable period of time. This can save your property. A chapter 13 can be used to resolve IRS problems. In a chapter 13, you must propose a plan that will govern payments the payments that you will make to the court over a 3-5 year period. Chapter 11 & 12 are for business and farmers and can be used to re-organize business and farm business debts. These types of filings are used by businesses and farmers.
