Before the contract can be declared in default for not making your payment on time, you must be at least ten days late and the lender must send you a "Notice of Right to Cure" the default. Auto Money appears to not be properly serving these Notices. South Carolina Law is clear. In a transaction between a creditor and a consumer, the creditor cannot repossess the collateral until he sends a notice of Right to Cure pursuant to 37-5-110 and 37-5-111. This also pertains to Rent-to Own transactions. Sending a notice has to be done either by courier service with an affidavit of service made, or certified mail - with return receipt. Both require strict proof of delivery. Delivery is defined as, " the actual handing to another of an object, money or document (such as a deed) to complete a transaction." Auto Money of South Carolina is not following the mandates of South Carolina Law and appears to be illegally repossessing motor vehicles and disposing of them at auction before a client of theirs is properly notified. This can result in the lost of Auto Money's license to do business in South Carolina, not to mention huge jury awards
