What an awful experience. I won my hearing, but it wasn't because of Lisa Salmonson or the rest of them, it was because the insurance company lawyer's made an error on his paperwork. I received a letter from the WBC stating the amount I was to be paid from the weeks immediately before the hearing. The retro check I received did not match up to the paperwork and I called Rafael....Rafael Hernandez was my contact afterwards and he just kept on telling me that he would "look into it". Do not trust him. As of today, I had a phone call with Lisa because Rafael finally passed me on to her after 4 months of sitting on his hands. According to her, Rafael had spoken to her 2 months prior about the issue, yet I never received a single phone call during that time indicating that he had given up. Then I received a call today telling me that the situation was explained to me (according to Rafael's notes. I offered up my own notes, but obviously they didn't care) and that my math is wrong. As it stands now, either my math is wrong, her math is completely wrong or I was unaware of a specific rule of worker's compensation law that is not told to you by any of the parties involved. Lisa could not remember when I asked what it is (Just a reminder, this is a worker's compensation law firm). She insists on the latter. Research is underway.Lisa also kept turning the conversation to "If you want us to file for an underpayment...." every single time Rafael's incompetence was brought up. Obviously, lawyers know when to not acknowledge their law firm's mistakes and to instead try to bring up a moment of anxiety by instead talking about what could happen if you file for the underpayment. Cheap trick. Don't fall for it. Besides that, they insist on you going to their recommended doctor and the doctor's office that they send you to is a joke. Besides never once calling me to confirm my appointments, they forgot to document my last appointment and were surprised to see me )they told me I didn't have any appointments scheduled on any day, but obviously it's part of the checking out process before you can leave and it has never happened to me before at any doctor's office. The doctor has shown up a half hour late for 3 of my visits and told me to stop going to physical therapy if it's not going to help. He also is recommending me for "sedentary work" because of my back injury, but seems to have not read any of the information that they ask me during every visit, because I cannot sit down for a full work day. I can't even sit down for a half hour without pain. Anyway, there are a million law offices around Bay Shore. This should be your last stop. So if they try to underhandedly intimidate you, the least you can do is stand up for yourself and write about your experience.I honestly wish I could switch law offices at this point, but according to what I've read, it would be too much of a hassle.
