  Second chair in class action bad faith case for failure to appropriately administer workers' compensation. Verdict in favor of defendants overturned based on juror misconduct.
• Wrongful Termination
  Michael Milodragovich’s practice for the past 30-35 years has progressed from being mostly a litigation practice to being exclusively a litigation practice. In that time frame he tried many complex cases ranging from deliberate homicide to products liability to wrongful death, from personal injury to wrongful termination.   Rachel’s practice focuses primarily on insurance defense and coverage analysis. She is well-versed in the nuances of Montana’s unique insurance landscape, and has represented institutional clients in bad faith cases and administrative proceedings before the Insurance Commissioner. Much of her defense work has been in construction litigation, including construction defects, liens, and home inspector professional liability. She also frequently advises clients on employment matters and has successfully defended a variety of employment claims both in district court and before administrative agencies, including OSHA, EEOC, and the Montana Human Rights Bureau. Rachel has had cases before the Montana Supreme Court and the Ninth Circuit Court of Appeals, and has also appeared in several tribal courts in Montana.

Brad also has in-depth experience and expertise in handling lawsuits and disputes regarding insurance coverage.
• Landlord-Tenant Disputes
  2006 MT 98, 332 Mont. 112, 136 P.3d 970. Counsel for landowner alleged to have caused a fire that destroyed plaintiff’s property. Obtained a defense jury verdict, client was awarded attorney fees under Montana’s Landlord-Tenant Act. The award was upheld by the Montana Supreme Court.
