- Eminent DomainIn Nevada, expanding public use projects initiated by governmental entities including the state, counties, and cities often result in taking land from individuals and businesses during the course of the projects. These governmental entities have a fundamental power to take private property for a public purpose without the landowner’s consent and even if the landowner does not want to sell his land. This power is known as the right of eminent domain or condemnation. Although governmental entities retain this power, eminent domain law requires that the government compensate the landowner at the fair market value (taken at the land’s highest and best use). While it may appear that the governmental entity is attempting to protect an individual’s or a business’s interests throughout the condemnation process, this generally is not the case. Thus, creating a comprehensive estate plan is extremely important because it allows an individual to not only plan for the disposition of his or her assets after death but also to plan for contingencies that may arise during the individual’s lifetime.

- BankruptcyChapter 7 Bankruptcy is commonly referred to as “liquidation bankruptcy.” When an individual proceeds under Chapter 7, a trustee is appointed by the bankruptcy court. The trustee then gathers all of the individual’s property (except any property that is exempt), sells (“liquidates”) it, and distributes the proceeds of the sale to the individual’s creditors. At the end of this process, any outstanding debts are discharged (eliminated). If proceeds from the liquidation sale do not cover all of the individual’s debts, the creditors then chalk-up any losses and move on, while the individual starts anew with very little assets leftover. The Chapter 7 process generally takes about four to six months.
