  Incompetency/Guardianship Proceedings: These services concern a determination of a person’s incompetence by way of a Superior Court proceeding when an adult is unable to manage his own affairs, or is unable to make important decisions regarding his person or property. Guardianship is a legal relationship by which the Superior Court authorizes one person (the guardian) to be substitute decision maker for another person (the incompetent adult). We advise and assist with the statutory procedure required to resolve these complex issues in a way that is in the incompetent person’s best interest.

She offers advice for personal and health care planning for long-term care needs; asset protection and navigating the laws governing Medicare and Medicaid; litigation and administrative advocacy for those seeking public benefit and those who are victims of elder abuse (financial or consumer fraud); special needs counseling including Special Needs Trusts and other related issues. Her practice area also encompasses Incompetency and Guardianship matters which often include children with disabilities transitioning to adulthood and continued advocacy of their specific needs.

  Mansell was born and raised in New Haven County, Connecticut. He works out of White & Allen’s Morehead City office where he primarily practices in the area of real estate law, but also handles some estate planning and administration and simple corporate law transactions. He is licensed to practice law before all North Carolina state courts.

  As a member of the North Carolina State Bar since 1989, John is admitted to practice in all courts in North Carolina. He is certified by the North Carolina Dispute Resolution Commission as a mediator. John was the Chair in 2022 and is a member of the Antitrust and Complex Business Disputes Litigation Section of the North Carolina Bar Association. He is also a member of the Litigation, Business Law, and Dispute Resolution Sections of the North Carolina Bar Association. John served as the chair of the Eighth Judicial District Bar Candidate Committee for over 25 years.

  In 2022, Mansell earned his law degree from Wake Forest University School of Law. During his time there, he completed an internship with a real estate law firm in Charlotte.

  Special Needs (disability) Trust Planning: Consists of advising and preparing specialty trusts for persons living with a disability who are either seeking to preserve their continued eligibility for supplemental security income (SSI) and Medicaid benefits or become eligible for those benefits. This usually involves adults whom receive monies which could impair their eligibility for benefits, including those whom receive retroactive Social Security Disability benefits, an inheritance or gift from a family member, or settlement or judgment proceeds from a personal injury lawsuit (including working with White & Allen’s personal injury attorneys to resolve cases). We advise clients of their options to preserve the funds for the disabled person’s benefit while ensuring that public assistance benefits are not reduced or eliminated.

  Oliver was born in New Bern on September 2, 1978. Prior to joining White & Allen, P.A. in 2020, Oliver worked for ten years as an attorney for the North Carolina Department of Transportation, handling almost exclusively eminent domain litigation. Prior to that time, he represented clients in a broad range of litigation matters, including federal prisoner litigation, state personnel litigation, criminal appeals, medical malpractice defense, general insurance defense, etc. He has also argued before the North Carolina Supreme Court.
