- Criminal DefenseWhile in law school, Daniel gained litigation experience in criminal defense and civil rights law. He has worked in both private practice and public defense at The Legal Aid Society of Nassau County and the Hofstra Criminal Justice Clinic. In his final semester, he was one of ten graduating students to be selected as a Pro Bono Scholar, which enabled him to return to The Legal Aid Society of Nassau County and represent indigent criminal defendants. Daniel is a member of the Nassau County Bar Association.
- Wrongful DeathIn an action for medical malpractice and wrongful death, it was alleged that the medical defendants were negligent in failing to timely diagnose and treat the decedent’s cytomegalovirus colitis which allowed decedent’s condition to worsen and result in his death at the age of 53. CG&P represented the endoscopy facility where colonoscopies were performed on the decedent by a gastroenterologist. CG&P moved for summary judgment to dismiss the plaintiff’s complaint on the grounds that there was no basis for direct liability or vicarious lability as the gastroenterologists who performed procedures were not employed by the endoscopy facility. The case was handled by CGP Partner Michele R. Levin and CGP Associate Alexandra Nieto.

- Business FormationWhile in law school, Alex interned for the Honorable James P. McCormack of the Nassau County Supreme Court. Prior to joining CG&P, Alex gained experience working in private practice in the areas of commercial contract law, business formation, real estate, and family law. Alex is a member of the New York State Bar Association.
- Business DisputesIn an action alleging violations of New York General Business Law, breach of contract, and breach of the duty of good faith and fair dealing, it was alleged that CG&P’s client, a dental implant provider, violated the New York General Business Law by engaging in deceptive practices and false advertising. CG&P successfully moved to dismiss the complaint on the grounds that plaintiff failed to state viable causes of action, and that plaintiff’s causes of action were contradicted by documentary evidence. The case was handled by CG&P Partner Domingo Gallardo and Associate Alexandra Nieto.
- Employment DiscriminationWhile in law school, Alexandra was a student clerk for the Honorable Jack B. Weinstein of the Eastern District of New York. She was a Notes Editor for the Cardozo Law Review, and her Student Note on Familial DNA Searching was published in 2019. Prior to joining CG&P, Alexandra gained experience working in private practice in the areas of employment discrimination and shareholder disputes. Alexandra is a member of the New York State Bar Association, the Nassau County Bar Association, and the Hispanic National Bar Association, and she is currently a Co-Chair of Cardozo’s Black Asian Latino Law Student Alumni Group.

While employment disputes often result in litigation, the Firm provides risk management to minimize exposure, and educates their clients as to the documentation litigators rely upon in their defense.

The Firm counsels clients, including religious institutions, Fortune 500 companies, medical facilities and commercial carriers, with respect to issues ranging from human resource administration to discrimination, sexual harassment and sexual abuse claims.
- Real Estate LitigationCG&P defends attorneys from claims stemming from a broad array of underlying matters, including commercial and real estate transactions, real estate litigation, personal injury matters, criminal cases, trusts and estates matters and tax disputes. Conflicts of interest and ethical issues arise in many attorney liability cases, and CG&P’s attorneys, who are active in the Ethics and Law Practice Management Committees of the local and state Bar Associations, are well-qualified to address them.
- Premises LiabilityIn a New York County premises liability action, the plaintiff claimed that she suffered severe injuries when she was struck by a falling ceiling in an apartment located in a building owned by CG&P’s client. CG&P moved for summary judgment in favor of its client, and the Court agreed with CG&P’s argument that no reasonable fact finder would believe plaintiff’s version of events. In reaching that conclusion, the Court determined as a matter of law that CG&P’s demonstration that the accident did not occur as plaintiff alleged was more credible than plaintiff’s own self-serving deposition testimony. The case was handled by CG&P Associate Renton D. Persaud, along with CG&P Partners Domingo Gallardo and June Reiter.
- Construction LitigationCG&P maintains a consistent presence in New York’s Appellate Departments and the United States Court of Appeals for the Second Circuit, and has had decisions of significant importance published in the areas of health care litigation, lawyer’s professional liability, construction law, insurance coverage issues on both the primary and excess levels, products liability and church and charitable organization law.
- Real Estate TransactionsCG&P Obtains Dismissal of Legal Malpractice Action In an action alleging legal malpractice, tortious interference with contract, fraud and negligent misrepresentation, CG&P obtained summary judgment in favor of its client, the seller’s attorney, in a disputed real estate transaction.
- Property DamageShe has extensive experience in the areas of construction law, construction defect, property damage, individual and institutional professional liability defense, including medical, healthcare and dental malpractice, employment law, premises liability, and complex personal injury litigation on the trial and appellate levels. Martindale Hubbell has rated her AV Preeminent, which is the highest possible rating in both legal ability and ethical standards, and Hofstra University School of Law awarded her the Outstanding Women in Law Award in 2016. She is a member of the American Bar Association, New York State Bar Association and the Nassau County Bar Association.
- Personal InjuryHe is past Dean of the Nassau Academy of Law, the teaching arm of the Nassau County Bar Association, and past Chairman of the Nassau County Bar Association Committee on Professional Ethics. He has developed and chaired programs for avoiding and defending legal malpractice claims for The New York State Bar Association and the Nassau County Bar Association; and has lectured and written extensively on a range of topics concerning professional malpractice, legal ethics, personal injury and institutional liability for many publications and organizations. He is a frequent lecturer of trial and appellate advocacy at the New York State Bar Association, the Nassau County Bar Association and Hofstra University School of Law. Mr. Catalano is a former member of the board of directors of SPOHNC (Support for People with Head and Neck Cancers), a national support group for people suffering from the debilitating effects of head and neck cancers.

- TrustsCG&P Obtains Dismissals of Three Attorney Liability Cases in Three Weeks For the third time in as many weeks, CG&P has obtained the dismissal of an action against an attorney. In a decision issued late last week, CG&P’s pre-answer motion to dismiss fraud and breach of fiduciary duty claims against a trusts & estates attorney was granted by Nassau County Judge Jack Libert.

- Debt CollectionWith Victory in Second Circuit, CG&P Secures Dismissal of Class Action Against Law Firm The United States Court of Appeals for the Second Circuit affirmed the dismissal of a class action lawsuit against CG&P’s client, a New York City law firm. The plaintiff alleged that CG&P’s client, in the course of representing property owners, violated the Fair Debt Collection Practices Act in communicating with tenants regarding rent arrears. This is the first time that the Second Circuit applied its holding in Emanuel v. American Credit Exchange, 870 F.2d 805 (2d Cir. 1989) to a claim under 15 U.S.C. § 1692g.
