- Child SupportPriority debt must be paid in full over the plan. This includes past-due child support/alimony and taxes incurred in the past three years. If the taxes were due more than three years before the case was filed, then the taxes are not priority and they may be dischargeable. If the taxing authority has filed a lien, then the taxes may be treated as secured debt. Since tax issues in bankruptcy are complex, you should discuss this with one of our Ocean Springs Chapter 13 attorneys.
- Spousal SupportAt the conclusion of a Chapter 7 bankruptcy, your debts are discharged. This means that you will not legally owe the debt anymore and the account can no longer be reported as “past due†or “in collection†. Chapter 7 is commonly used for medical bills, personal loans, judgments, payday loans, and credit card debt. There are exceptions to discharge, however, for some taxes, most student loans, child support, alimony, and certain other debts including debts from drunk-driving accidents or intentional torts - such as assault. Taxes can typically be discharged if the taxes were due more than three years before the bankruptcy was filed, the taxes were filed more than two years before the bankruptcy was filed, and the taxes were assessed more than 240 days before filing. Due to how our courts interpret the law, student loans that are federally guaranteed are usually nondischargeable, but private student loans may be discharged. Reach out to our experienced Biloxi and Jackson County attorneys to learn more about what happens after filing for Chapter 7.

- FraudEven though our consultations are free, it does cost money to file bankruptcy. These costs include attorneys’ fees, court costs and the costs of legally required credit counselling. Since Congress amended the bankruptcy code in 2005, it has become more difficult to file bankruptcy and very dangerous to file without the help of a lawyer. If you do not have an attorney, you may risk having your case dismissed, losing property that should be protected, or even facing jail time for bankruptcy fraud. Every bankruptcy case is different, and our pricing reflects that. Our Jackson County bankruptcy law firm offers free consultations via telephone, skype, zoom, or in-person to analyze your case and provide you with the best quote available.

- ForgeryTitle Insurance protects against claims from defects in title. Defects are things such as another person claiming an ownership interest, improperly recorded documents, fraud, forgery, liens, encroachments, easements and other items that are specified in an insurance policy. Certain lenders may purchase title insurance for some loans secured by real estate but lenders, purchasers and sellers can all benefit from having title insurance.

- BankruptcyQualification for bankruptcy depends on the specific chapter of bankruptcy. To qualify for a Chapter 7 bankruptcy, your income must be below median income, or you must pass the “means test†to determine if you are eligible. The means test looks at whether you can afford to pay back some of your debts if you were to budget differently and file a Chapter 13 repayment plan. You do not have to do the means test if your debt is mostly from operating a business, if you are a disabled veteran and your debts were incurred while you were on active duty, or if you are a guardsman/reservist and your debts were incurred while on active duty.

- Debt CollectionCreditors have a way of kicking you when you are down. If you are down on your luck and you owe money, creditors can add to your stress by harassing you with endless phone calls and abusive collection practices. Mississippi law lacks many consumer protection statutes that exist in other states, but Mississippians still have rights under federal law. Creditors violate these rights on a regular basis because they know that they can get away with it. Most consumers do not understand their rights. and many lawyers lack the knowledge and training to take these cases and win. Our attorneys are trained to recognize claims that you may have under the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, the Telephone Consumer Protection Act, and many other federal laws that protect your consumer rights. We can inform you of your rights, tell you how to deal with creditors, and, in some cases, take these companies to court. In most cases, the law provides attorney's fees, so you will not have to pay us anything to take your case.
