- Child Support“Child support is the amount of money that a court may order a parent, or both parents, to pay every month to help support their children. Each parent is equally responsible to provide for the financial needs of his or her children. The obligation to pay support is not enforceable until such time as a court makes a child support order. In order to get an order, a parent must file a motion asking for it.” Jennifer Lawton, Lerandeau & Lerandeau, Family Law Attorneys Fresno.
- Child Custody and VisitationA property division or child custody dispute is one of the most difficult and emotionally taxing legal battles you may face. These court decisions or mediation sessions make a lasting imprint on your life and the lives of your children.
- Adoption
- PaternityA Voluntary Declaration of Paternity is a California governmental form that, when signed by both parents, establishes them as the legal parents of the child. The form must be signed voluntarily. No one can force either the father or the mother to sign the form. The purpose of the Declaration of Paternity is to officially and legally establish who the father of the child is when the mother and father are not married to each other. A properly signed Declaration of Paternity has the same effect as a court order establishing paternity for the child, without anyone having to go to court. A Voluntary Declaration of Paternity can be set aside within two years under certain circumstances.
- Premarital AgreementI was married to a lady who was a French citizen. Prior to us getting married, with the belief that she would inherit a sizable amount of high valued property in the South of France, my soon-to-be-wife asked me to sign a prenuptial agreement. I had no problem with that. Six years later we were going through a divorce. Paul represented me in this matter. I had told Paul that we had a prenuptial agreement that was written and filed in France, but that my copy had strangely disappeared. The only information I had was that the document was written in July of 1998 by a Notary (a very high level position in France) in a small city about a two hour drive north of Aix-en-Provence. I also remembered that the city had a small “Coca Cola Memorabilla Museum” in it.
- Spousal Support“Modifying Court Orders can be done as long as there has been no final determination. However, there are certain exceptions. Court orders intended to be modifiable at any time include almost anything involving children, e.g., custody, visitation, and support. Court orders concerning spousal support are intended to be modifiable unless there is language in the order making them non‑modifiable or depriving the court of jurisdiction to make changes. Court orders concerning the division of property are never usually modifiable except in instances of fraud, duress, mistake of law or fact, or breach of a party’s fiduciary duty.” Jennifer Lawton, Family Lawyers Fresno.
- Legal SeparationLike a Divorce, Legal Separation is an actual lawsuit. No one needs to have done anything wrong in order to file. California is a “no-fault” state. All a spouse has to allege is that the couple cannot get along. Legally, this is called “irreconcilable differences.” There is no requirement that these differences be proven. Any spouse can decide to file a Legal Separation even if the other spouse does not want to get one. The only thing the family court is interested in is helping spouses reach a fair agreement concerning all of the issues in their case.
- AnnulmentAn annulment (or nullity of marriage) is when a court determines a marriage is NOT legally valid. After an annulment is granted, it is as if a marriage never happened because it was never legal.” Jennifer Lawton, Fresno Divorce Attorney.
- Child AbuseI recommend Jennifer Byers-Lawton. There should be more attornies like Attorney Jennifer Byers-Lawton. She is an amazing, intelligent professional. She gave us direction and comfort through a gruelling custody battle which involved child abuse. Attorney Byers-Lawton is very professional yet caring and she was always very well versed with the intricacies of our case. I would highly recommend her to anyone who is looking for an attorney that can get the job done and does it well. We were so blessed to have her representing us.
