- Wrongful DeathA wrongful death claim is a lawsuit to recover damages for a fatal injury that occurred as a result of a careless or negligent action. It can be the act of a person or a corporation. A wrongful death claim is a claim for the surviving family members. When a wrongful death happens, the entire family is injured. The damage to a spouse or parent is devastating, not only because of the loss of the person but also because it changes a family’s financial situation.
- Traffic ViolationsThis driver suddenly turns left across the path of an oncoming motorcycle. The driver tells the police the motorcyclist must have been speeding as he never saw him. We knew there was more to this story. We locate witnesses who testify the motorcyclist wasn’t speeding and was clearly visible even from behind the driver’s car.

- MurderOur client, a police officer, had responded to a call from two young women who reported being harassed by a man with whom they had been drinking. Upon arriving at the premises our client approached the man’s truck when he was ambushed and shot in the abdomen by a.44 Magnum handgun. The shooter then approached the cruiser, possibly with the intent of finishing off the officer, when our client returned fire and brought the shooter down. The shooter was eventually convicted of attempted murder. The shooter’s weapon belonged to his father, who we claimed should have kept it locked up as the law required.
- Identity TheftIt may be difficult to spot financial exploitation unless you have access to the victim’s bank accounts or other assets. Still, you should watch out for situations where the victim suddenly cannot pay bills or allows someone new or unknown to handle banking for them.
- Hit and RunThe relevant law is typically referred to as the statute of limitations. For most injuries on duty that develop into third party claims, three years from the date of incident is the applicable statute of limitations in Massachusetts. However, when there has been an injury involving a stolen car, a car used without authority, or a hit-and-run vehicle that was never identified, successful claims can be made in some cases six years or more after the accident. After the relevant statute of limitations period expires, a lawsuit cannot be filed in court. Another exception to the three-year rule occurs when the injured officer was exposed to some harm or danger without discovering that situation until after the three-year period expired. For example, if the officer is exposed without his knowledge to a toxic substance during an incident, the three-year statute of limitations may not begin to run until he learns of the exposure or should have learned of it. This is known as the discovery rule and in certain fact situations it may apply.
- Workers CompensationGranted, if you are injured on the job there are sometimes workers compensation benefits, but even if you are fortunate enough to receive benefits, there will remain many financial issues the benefits will not address. For example, police officers and firefighters injured at work, do not receive any compensation for a substantial part of their income while they are out of work which they rely on to support themselves and their families.
- Construction LitigationPaul Johnson brings more than 30 years of wide ranging legal experience to the firm. His experience includes personal injury matters, insurance and construction disputes, and all sorts of complex civil litigation. He is also licensed to practice in New Hampshire.
- Property DamageOne focus of Attorney Johnson’s practice is insurance coverage litigation. Insurance companies frequently deny valid claims, claiming that coverage is excluded by the language of the insurance policy itself. Ballin and Associates, LLC, will take on the insurance companies, forcing the insurers to pay when the policies they issue provide coverage for legitimate claims. The majority of Attorney Johnson’s insurance coverage litigation involves personal injury claims, but he has also handled insurance coverage matters relating to property damage claims, such as fires and floods, professional liability claims, and other types of business insurance claims. Taking on the insurance companies requires creativity, diligence, experience, and a willingness to take cases that other lawyers may not be willing or able to handle. Attorney Johnson brings these skills and abilities to every case that he handles, whether large or small, and has achieved a remarkable level of success for his clients.
