Every year, employers fail to pay employees thousands of dollars in overtime. One former Department of Labor investigator commented that if you want to find a wage and hour violation all you have to do is stand in the downtown area of any city, close your eyes, throw a rock and then investigate the employers in whatever building the rock hits. In fiscal year 2005, the Department of Labor recovered over $166 Million in unpaid overtime. Attorneys recovered millions more in private lawsuits Under the Fair Labor Standards Act (FLSA), employees are owed overtime at a rate of pay of at least 1.5 times their regular rate of pay. There are exemptions from the law, but these exemptions are narrow and limited. Some employers intentionally choose not to pay earned overtime. Other employers fail to pay overtime because they do not understand the law. Regardless, the FLSA holds both types of employers responsible.
