  Richard M. "Rich" Albert is Counsel in the Real Estate practice group, focusing primarily on business law. He practices out of the Firm's office in Pittsburgh, Pennsylvania.
• Business Transactions
  Brittany routinely handles matters involving various aspects of real estate transactions, including the preparation and issuance of Title Insurance; due diligence and title defect curative work relating to mineral transactions and acquisitions, as well as providing title opinions pertaining thereto; coordination and completion of real estate closings; drafting and negotiating commercial real estate documents relating to municipal finance deals, including but not limited to the preparation of Purchase and Sale Agreements, Bills of Sale/Assignment/Assumption, Deeds, Commercial Options and Leases. In addition to her work in the real estate and energy industry, Brittany also assists in a variety of commercial transactions, including tax-exempt financings, lease-purchase agreements, and general commercial acquisitions. She enjoys interacting with clients and helping them solve their issues, which is highly reflective in her work drafting agreements for commercial property deals.

  When needed, Rich reviews, negotiates, and drafts complex and routine commercial loan documents, including floor plan financing, warehouse loan agreements, and other commercial loan transactions.   Represented employers in state and federal courts in actions involving wage and hour claims, employment discrimination claims, and various harassment, retaliation, and wrongful termination claims
• Employment Discrimination
  The Fourth Circuit issued a decision yesterday, reinforcing a plaintiff’s burden in employment discrimination cases. In Balderson v. Lincare Inc., No. 21-1753 (4th Cir. Mar. 15, 2023), a three-judge panel reversed the trial court’s conclusion that Chandra Balderson’s termination from employment was the result of discriminatory animus based on her sex. The trial court reached this conclusion after a bench trial, solely upon finding that (1) Balderson had established a prima facie case of discrimination; (2) the employer’s proffered explanation for why it terminated Balderson was not credible; and (3) a male employee, who was disciplined less harshly for a similar infraction, was an appropriate comparator.

  Rich counsels clients with respect to complex and routine real property transactions, including the establishment of planned communities and residential and commercial condominium developments, construction agreements and related land acquisitions, and option agreements for multiple regional residential and commercial developers.
