Yours Truly, Todd G Tallerday Chapter 7 Bankruptcy Also known as liquidation bankruptcy, Chapter 7 bankruptcy releases debtors from specific debt through the selling of assets. Built into the Bankruptcy Code are exemptions allowing debtors to keep a certain amount of assets. These become exempt assets and are kept by the debtor. In most cases, people do not lose their assets; bankruptcy attorney Todd Tallerday can help you determine how to retain your possessions while gaining a fresh start. Once you file for bankruptcy, the "automatic stay" becomes effective, stopping most, if not all, collections activities. The harassing calls from creditors stop. Repossession and/or foreclosure stops. Garnishment stops. Usually within six months, most of your debts will be discharged and you will be free to begin a new financial life. Chapter 13 Bankruptcy For those whose incomes are too high to qualify for Chapter 7 or for those whose homes are facing foreclosure, Chapter 13 bankruptcy allows wage earners to develop an extended payment plan. In Chapter 13, losing assets is not the primary issue ¿ losing debt is. Debtors are allowed three to five years, depending on circumstances, to pay all or a portion of their debts. At the end of the payment period, certain debts are discharged, providing individuals with a fresh start. In some cases, second or third mortgages may be removed. However, as with Chapter 7, some debts are non dischargeable. These include government guaranteed student loans, most income taxes, alimony/child support, among other debts.
