Just like most states, there are many benefits to filing your petition on fault grounds if you can prove you spouse is committing adultery prior to the divorce being finalized. If your spouse is committing adultery Georgia courts can rule in your favor on issues like alimony and the distribution of marital assets. Since Georgia will recognize you still being legally married during the periods of pre-divorce separation, the fact that your spouse commits the adultery during the separation period does not preclude you from filing for divorce on adultery grounds. So even if your spouse has moved out and a separation agreement has been filed, you're still married therefore have to act as such until which time the divorce has been finalized by a judge.
