- Restraining OrderUnder the ordinance, if the court finds that a discriminatory practice has occurred it may issue an order prohibiting the practice and providing affirmative relief from the effects of the practice. The court may issue a temporary or permanent injunctive and other equitable relief and a temporary restraining order, and it may award actual and punitive damages, reasonable attorney’s fees, interest, and court costs or other appropriate relief.
- Employment DiscriminationWhen the employee sued for discrimination and retaliation, AutoZone filed a motion to dismiss the lawsuit, arguing that Chapter 11A did not provide a private cause of action for employment discrimination. Miami-Dade Circuit Court Judge Lourdes Simon agreed with AutoZone’s reasoning and dismissed the lawsuit. The employee then appealed.
