- FraudWe served as co-counsel in purported class action securities fraud litigation, representing the defendant company and several of its officers, in an action wherein the plaintiffs claimed that the defendants made repeated false and misleading guidance projections and engaged in false financial reporting throughout the class period, and also alleged insider trading by one of the officers. The federal district court granted defendants’ motion to dismiss and the plaintiffs later voluntarily dismissed their appeal.

In this employment discrimination lawsuit, the Sixth Circuit accepted our client’s arguments and reversed the district court’s severance of certain aspects of an arbitration agreement while affirming the district court’s findings that the dispute was arbitrable and the arbitration clause lawful. Represented utility clients in the Kentucky Court of Appeals and Franklin Circuit Court (the Kentucky state capitol), successfully defeating property owners’ challenge to the companies’ authority to acquire property by eminent domain to complete construction of a transmission line necessary to implement a newly constructed generating plant in a project valued at $1B. - Land Use and ZoningLead counsel on an anaerobic digester project that was to process 100 million gallons of distillery stillage into renewable natural gas, including interconnecting with the gas utility, managing local planning and zoning process, engaging community partners, and procuring a $2.1 million incentive under KY’s Incentives for Energy Independence Act.
- Property DamageUnion Circuit Court, Morganfield, Kentucky – Our trial lawyers obtained a defense verdict in favor of an electrical utility company and tree trimming company on property damage claims related to a tree fall accident.
- Personal InjuryJefferson Circuit Court, Louisville, Kentucky – Our trial lawyers obtained a defense verdict in favor of an electrical utility company in a motorcycle lawsuit seeking $4.5 million in personal injury damages.
- Disability DiscriminationWe represented the defendant company and majority shareholders in an action brought by a minority shareholder whose employment was terminated by the company. The plaintiff alleged claims of disability discrimination, breaches of fiduciary duty and breach of contract. The defendants counterclaimed, seeking an order requiring the plaintiff to tender his shares to the company pursuant to a buy-sell agreement.  We prevailed on summary judgment, obtaining dismissal of the plaintiff’s claims and an order requiring plaintiff to tender his shares to the company.
- Estate PlanningWe represent developers, owners, creditors, commercial landlords, tenants and title insurance companies in a wide array of real estate litigation matters, including past experience handling eight-figure commercial foreclosure actions and defending lien priority contests and boundary disputes.
