Criminal Law

• Criminal Defense
  After graduating from Fitchburg State University in 1976 and Suffolk University Law School in Boston in 1979 he spent four decades practicing law, representing clients in the area of criminal defense, motor vehicle violations, family law, civil litigation, and bankruptcy. He briefly worked for the Worcester County District Attorneys Office and then practiced in Bailey & Burke Law Offices in Clinton for 38 years. He was also a member of the Massachusetts, New Hampshire, Worcester County, and Clinton Bar Associations.
• DUI/DWI
  Drunk Driver – A drunk driver rear-ended our client’s motor vehicle, causing our client, a 42-year-old office worker, who was an injured passenger to have severe, lifelong injuries. In addition, we represented the victim at all criminal court proceedings and the defendant was convicted of Drunk Driving.
• Wrongful Death
  Wrongful Death – Pedestrian v. Auto – Our client was walking on the side of a roadway and was struck by a drunk driver. Our client, a father of two children, died as a result of the injuries he sustained. A claim was brought against all responsible parties and the case settled out of court for the full amount of the insurance coverages. After settlement we established a Trust to provide for his minor children.
• Traffic Violations
  Brain Injury – Passenger v. Driver – An automobile driven by a teenager was speeding, left the roadway and collided with a tree, causing our client, a rear-seat passenger to sustain a head injury. After we filed suit against the teenage driver and his parents, we structured a settlement for our client with a guaranteed payout of 1,750,000.
• Sex Crimes
  In Massachusetts, p remise liability refers to cases involving an injury or an assault sustained on premises that did not have adequate security. Sometimes these can be a simple “ Slips, Trips and Falls ” case, or as severe as a building collapse or parking garage robberies and/or sexual assaults.

  Criminal law — We provide experienced criminal defense to people charged with drunk driving (DUI/DWI/OUI), drug crimes, probation violations, assault and battery, domestic violence and other misdemeanors and felonies.

  Michael joined the Worcester County Bar Advocate Program early on in his career. He handled cases out of the Clinton District Court which serves many of the surrounding towns. The court is located some five (5) minutes from the Law Offices of Bailey and Burke in downtown Clinton. The Bar Advocate Program provided exceptional experience in the handling of all types of district court criminal matters including, but not limited to, OUI, Assault charges, Drug Offenses as well as all levels of motor vehicle/Registry of Motor Vehicle matters.

  Real estate law — We assist with the purchase and sale of residential and commercial real estate, including the handling of closings.
• Premises Liability
  For example, recently Walmart stores have been sued for not adequately protecting their parking lots in areas where there have been multiple robberies and/or sexual assaults. It was shown through aggressive investigation that one particular Walmart had multiple police visits due to these ongoing problems. They also filed numerous internal reports dealing with these crimes; however, they took virtually no steps to provide protection for their patrons. Because Walmart failed to address the situation, millions of dollars have been paid out to various victims who accused Walmart with premises liability claims.
• Construction Litigation
  Construction defects refer to cases involving an injury due to faulty construction. One only needs to look to your local news to see everything from the collapse of buildings where wedding receptions were being held, to the collapse of piers and decks where parties were taking place, to see the devastation that can occur in a construction defect accident. The more subtle losses occur when parking garages are improperly designed, which results in motor vehicle accidents. Sometimes traffic flow in parking lots is improperly directed without adequate stop and yield signs, which can result in pedestrian injury and car accidents.

  An uninsured motorist claim is where the person who is responsible for your injuries had no insurance and you are filing a claim against your own uninsured motorist coverage. An uninsured motorist claim is available if you have uninsured motorist coverage from your insurance company. Your insurance company assumes the role that would have been taken by the responsible party’s insurance company if there had been insurance, except that uninsured motorist coverage does not cover property damage.
