- Criminal DefenseYou have clicked on a link and have been brought to this page to take that initial step of contacting attorney Tom Nash. You have decided to secure experience, consistently successful legal service for your criminal defense case. Perhaps you have apprehensions – are worried about costs, or have never had to hire an attorney before…or wonder if attorney Nash can make a difference in your legal situation.
- DUI/DWI
- Traffic ViolationsThe National Highway Transportation Safety Administration (NHTSA) and the California Department of Motor Vehicles (DMV) have identified many driving behaviors as possible identifiers of DUI driving: making wide turns, weaving, etc. (but not, interestingly, speeding). A cop may pull you over for any of these whether or not you’ve been drinking. Obviously the police are interested in what anybody is doing driving late at night or in the early a.m. when the bars close. You may be pulled over for what is called a “pretext stop” and have a cop alleged that you didn’t dim your headlights or that your license plate lamp doesn’t properly illuminate your plate.
- Sex CrimesNote: The Law Offices of Thomas Vinson Nash declines to accept sex crimes, homicides, arsons, robbery or violent felonies other than domestic violence cases.
- Robbery
- Theft
- MisdemeanorsThe word “misdemeanor” may seem a harmless word in terms of what it means for you if you have been charged. After all, it is not a felony. Yet the fact that the penalties for a misdemeanor may be less severe than those of a felony conviction does not mean that it is any less serious.
- Drug CrimesMonterey County has a very active drug court. This speaks to the prevalence of illegal substance possession, distribution and cultivation in our communities. Yet it also speaks to an underlying issue related to drug defense and crimes — elevating charges. Marijuana Law enforcement and the courts aggressively pursue convictions for those charged with a drug crime.
- AssaultIf you have been charged with a crime such as spousal abuse or must appear in court on a domestic assault and battery charge, do not hesitate to contact a criminal defense attorney with over 30 years of experience. Contact the Law Offices of Thomas Vinson Nash today for a free initial consultation. We look forward to assisting you.
- Juvenile CrimesAttorney Nash’s focus when defending minors accused of juvenile crimes is to seek an alternative resolution of charges. He apprises families of and recommends various forms of diversion and probation. If you or a minor family member has been charged with truancy, underage drinking, assault, vandalism, gang affiliations, gang violence, DUI or drug possession, rely upon attorney Tom Nash. He believes in helping families in crisis.
- Probation ViolationFirst offense DUI’s without aggravation (such as an accident, an excessively high BAC, refusing a blood test or a probation violation on another matter) are generally sentenced to 5-10 days which often can be performed on Monterey County’s Work Alternative Program (effectively community service); a fine of approximately $2000 plus add-ons on which you may make monthly payments; a three-month first offender driving program (nine months if your BAC is.20 or above) and five years non-reporting court probation. The DMV will also suspend your license for a minimum of 30 days. A first offense conviction will also enhance any subsequent DUI conviction for 10 years.
- HomicideWhether you have been charged with DUI or DWI first offense and fear the loss of your license, have been in a DUI-related accident resulting in a vehicular homicide charge, or are a repeat offender and are concerned that you will have to face jail time, attorney Tom Nash will provide you with counsel and defense services that can make a difference. Attorney Tom Nash applies over two decades of experience to the efficient, effective handling of DUI matters and is a contributor to the California Drunk Driving Law by Kuwach, Burglin and Simons. No wonder he is referred to as Monterey County’s DUI guy.
- Shoplifting
- Restraining OrderMonterey County has a domestic violence court in which those charged with abusive or violent behavior in the home must appear. Crimes of domestic violence or violations of a restraining order are taken seriously in our region. Law enforcement is very aggressive with the investigation and arrest of those who have allegedly perpetrated these incidents.
