  Hagerty & Brady has extensive experience in probating decedents' estates. We represent our clients' interests fully from initial consultation and appointment of the estate representative through final distribution and accounting.   Since the commencement of the Western District of New York's Mediation Program which became operative in 2006, Mr. Brady has mediated nearly 400 Federal Court lawsuits. These mediations have included wrongful death actions, commercial disputes, trademark litigation, admiralty disputes, personal injury actions, FDCPA actions and numerous other matters. In addition to his role as a Federal Court panel mediator, Mr. Brady is frequently requested to mediate State Court disputes in Buffalo and Rochester. He has also been engaged to arbitrate disputes both as single arbitrator and as a member of a panel.

  Mr. Brady's litigation practice has been widespread, including personal injury, insurance defense, construction law, environmental law, commercial law, employment disputes, legal malpractice and aviation law. He has tried complex cases in state and federal court on behalf of plaintiffs and defendants.

  We assist clients in selecting a business entity appropriate to their objectives, tax purposes, and the nature of business operations, as well as minimization of their risks and liabilities. We also advise and draft documentation for businesses in transactional matters. We also handle real estate matters for our business clients, including commercial leasing, purchases and sales of real estate, and construction loans.
• Construction Litigation
  In a construction dispute, our client retained us after being sued by a project owner for more than $100,000. The plaintiff had contracted our client to build two barn-like structures on a property in Clarence. After a number of disagreements, and for reasons both sides disputed, our client stopped work on the project. The plaintiff hired replacement contractors and sued our client for damages. We asserted a counterclaim on behalf of our client. After two years of litigation, including a series of successful motions on behalf of our client, the plaintiff agreed to withdraw its entire claim and mutually walk away from the dispute.

  During his decades of practice, Tom successfully navigated both sides of the plate, sometimes defending lawsuits on behalf of individuals and companies, especially in asbestos cases, while at other times representing personal injury plaintiffs in negligence, strict products liability and Labor Law cases. Throughout his career, Tom acquitted himself with hallmark professionalism, empathy, and affability, which he extended to his clients, to the bench, and to his opponents.
