She earned her bachelor’s degree in political science at the University of South Florida in December of 1991. She is a sole proprietor and solo practictioner that works on a variety of cases including Family Law matters, Criminal Defense, Probate and Guardianship and Plaintiff’s Personal Injury cases. Elaine also devotes a small portion of her practice to representing Plaintiffs in employment discrimination claims before federal and state courts and administrative agencies. Elaine is currently looking to expand her practice into the area of Sports and Entertainment Law.

- Criminal DefenseIf this is your first time being arrested, you are probably wondering anxiously what comes next? You must be brought before a criminal Judge within 24 hours. The Judge will advise you of the criminal charges filed against you and whether or not you can be released on your own recognizances or on bond. If there is no bond, you must get an criminal law attorney to file a Motion to set a bond. The next step is the arraignment which takes place about 30 days after your arrest, it is at this hearing you enter your plea of not guilty. If you have a criminal law attorney, much of the preliminary hearings are covered by the attorney and you may not have to attend them all. If you have a public defender representing you, you will likely have to attend all hearings. After the arraignment, your criminal law attorney, be it private or public defender, will begin to request and receive the evidence the state has against you. Likewise, if you have evidence of your innocence that you plan to use at trial, this must be disclosed to the prosecutor. After your criminal law attorney has obtained or viewed the evidence the State plans to use against you he or she will advise you whether or not they believe you will be successful at trial. A trade secret is a formula, practice, process, design, instrument, pattern or compilation of information which is not generally known or reasonably ascertainable, by which a business can obtain an economic advantage over competitors or customers. An example of a trade secret would be the ingredients that go into making “Kentucky Fried Chicken”, only Colonel Sanders knows. Trade secrets are by definition not disclosed to the world at large. Instead, the owners of trade secrets seek to keep their special knowledge out of the hands of competitors through a variety of civil and commerical means, not the least of which is the use of non-disclosure agreements and non-compete clauses. The validity of non-compete clauses has been challenged over the past few years and if the non-compete clause is not unreasonable in radius or duration they have been upheld.
