- Estate PlanningMost people think of Estate Planning as the drafting of a will, or possibly a trust, to govern the distribution of their assets upon death. Although determining how and when assets are to be distributed after death is certainly one of the primary reasons for Estate planning, there are many other purposes and issues for consideration in the drafting of Estate Planning documents. For a young couple with children, for example, who they desire to be the guardian for their children in the event of their death is usually the single most important issue for consideration. Parents may have a disabled child or a child with special needs and must consider how to best provide for such child’s care in the event of the death or disability of the parents. In such circumstances we must also take into consideration any public benefits which such child is receiving or may be entitled to.
- WillsThe practice of elder law actually describes the segment of the population to whom an attorney provides legal representation, rather than a specific area of legal practice, and consists of providing advice and counseling to older persons and their representatives with respect to those issues and concerns affecting the elderly. These include, but are not limited to, health and long term care planning; advance directives (living wills and health care powers of attorney); public benefits, such as Medicaid, Medicare, Social Security and Veterans benefits; housing alternatives for the infirm or those suffering from diminished mental capacity; surrogate decision-making; and the administration of trusts and estates.
