  Guardianship is a court supervised probate proceeding involving appointment of an individual to care for a person, manage a person’s financial affairs, or both. There are two kinds of guardianship: guardianship of the person and guardianship of the estate. Because the appointment of a guardian involves the loss of the proposed ward’s (the person subject to the guardianship) ability to make substantial and important decisions about his or her life, Texas has strict requirements that must be met in order to create a guardianship. For example, Texas requires proof of incapacity and there must be no less restrictive alternatives to the guardianship. For much of her career, Linda served as Senior Claims Attorney for an insurance guaranty association, analyzing coverage and managing litigation in both personal and commercial lines, including auto, homeowners, trucking, commercial liability, construction, medical and legal malpractice.  She has trained claims professionals in numerous tort and insurance topics, as well as Medicare Secondary Payer compliance.
