There are two kinds of guardianship: guardianship of the person and guardianship of the estate. Because the appointment of a guardian involves the loss of the proposed ward’s (the person subject to the guardianship) ability to make substantial and important decisions about his or her life, Texas has strict requirements that must be met in order to create a guardianship. For example, Texas requires proof of incapacity and there must be no less restrictive alternatives to the guardianship.
